 إِنَّ الْحَمْدَ لِلَّهِ نَحْمَدُهُ وَنَسْتَعِينُهُ مَنْ يَهْدِهِ اللَّهُ فَلاَ مُضِلَّ لَهُ وَمَنْ يُضْلِلِ اللَّهُ فَلاَ هَادِيَ  إِنَّ أَصْدَقَ الْحَدِيثِ كِتَابُ اللَّهِ وَأَحْسَنَ الْهَدْىِ هَدْىُ مُحَمَّدٍ وَشَرَّ الأُمُورِ مُحْدَثَاتُهَا وَكُلَّ مُحْدَثَةٍ بِدْعَةٌ وَكُلَّ بِدْعَةٍ ضَلاَلَةٌ وَكُلَّ ضَلاَلَةٍ فِي النَّارِ وَأَشْهَدُ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَحْدَهُ لاَ شَرِيكَ لَهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ أَمَّا بَعْدُ 
Praise be to Allah, we seek His help. Whomsoever Allah guides will never be led astray, and whomsoever Allah leaves astray, no one can guide. The truest of word is the Book of Allah and best of guidance is the guidance of Muhammad. My Lord, open up my heart [with assurance] And ease for me my task And untie the knot from my tongue That they may understand my speech.[20:25-28] Ameen


Transgender Act 2018 is a hot topic now days, some are in favor of it, and some are against it. Recently Senator Mushtaq Ahmad raised his voice against this act.

Let's dive into it and see what is wrong with this act and how it will affect our culture as a Muslim.

Definition of "Transgender" and "Intersex"

First let's see who are termed as "Transgender Person" according to this act and then let's see what a real definition of transgender is according to UN.

This image is from the official bill which can be found on the website of National assembly of Pakistan. So, the first issue that we see here is that they have used the term Transgender as an Umbrella and added Intersex, Eunuch (castrated male), Transgender Man and Woman in it. One should know the difference between Transgender and Intersex.

Intersex People are born with ambiguous sex characteristics that do not fit the definition of male or female. These are the people who this bill should have targeted. These people are the one who are not given their rights, jobs, education etc. If any bill is passed which protects their rights, then we support it, and they are only 0.05 to 1.7% of the whole world population

Transgender People are basically born with a specific gender identity, there is no ambiguity in it, they are either male or female but later on they change their gender based on their feelings or likeness, either by surgery or by wearing such clothes or using some other ways. 
Like for example if one person was born as a male and one day out of nowhere, he feels like being a female then according to this bill he can go to the NADRA or any other government office and say that I want to change my gender and they are obliged to do it in his/her official documents without any medical examination (that's the second issue) as it is legalized after this bill.

So now that we know the difference between these two terms. A sane Muslim, who is actually a Muslim, won't agree with this bill. If you would ask me then I would say that this is an act to smuggle and legalize LGBT in Islamic Republic of Pakistan by masking it under Transgender act and claiming it to be an act for Intersex people. 

Before diving into the issues which it may cause, as a Muslims and as this article is for majority Muslim audience so, we know by the study of Quran and even Bible that there was once a nation to whom Prophet Lut A.S was sent, and they were indulged in an act that no one before them did and they were destroyed only few, less than 10 people survived. The act was homosexuality.

Allah says in surah number 7 Al Aaraaf
And remember when We sent Lot [as a Messeng to his people and he said to them: 'Do you realize you practise an indecency of which no other people in the world were guilty of before you? (80)

You approach men lustfully in place of women. You are a people who exceed all bounds.' (81)

After these two verses Allah records the reply that those people gave, the same reply that people usually give nowadays if someone says that this act is against Quran and Sunnah.
Their only answer was: 'Banish them from your town. They are a people who pretend to be pure.' (82)

The punishment that Allah sent on this nation were two, they were turned upside down, the whole piece of land was turned upside down similar to a sandwich and then hot clay stones rained on them.

And when Our command came to pass, We turned the town upside down, and rained on it stones of baked clay, one on another, 11:82

If someone from this nation do such an act, then   

It was narrated from Ibn`Abbas that the Messenger of Allah (ﷺ) said:

“Whoever you find doing the action of the people of Lut, kill the one who does it, and the one to whom it is done.”

Issues due to Transgender Act 2018

There are some major issues which would rise due to this bill.

  1. This bill legalizes gay and lesbian marriages, how? as this bill allows someone to change his gender based on his/her feelings, so if a person was born as a male but he changed his gender to female only in official documents then legally that person can marry a male person and vice versa.
  2. A person can violate the rules of inheritance set by Allah, if she is born a female and she change her gender to male then that person can get the inheritance which a male would get and vice versa.
  3. The major issue, if a male person changes his gender to female, then our mothers and sisters are not safe in female washrooms, female gym, female swimming pool and other places because that male person is legally now female and legally you can't do anything about him.

I would ask everyone to raise their voice against this bill. This bill was presented by these Muslim parliamentarians, and this bill was passed in May 2018 by the Houses of Islamic republic of Pakistan. I don't know, were they drunk or what. Praise to Senator Mushtaq Ahmad who raised his voice against it. According to Senator Mushtaq, he asked and was submitted a report by interior ministry in senate that almost 30,000 people have changed their gender already from the day this bill was passed. 

I would request you to not elect such duffers as our parliamentarians who to please foreign powers go to such extent. As former minister of human rights Shireen Mazari said that even Trump praised this act of ours. 🤦‍♂️🤷‍♂️
