Rapist should they be punished publicly?

Motorway Rape Incident

A few days back a very tragic incident happened on Motorway Lahore. A women with her kids were going to Gujranwala from Lahore at night around 12 o'clock, her car broke down on the motorway, authorities say that there was a shortage of fuel. Normally in a sensible society (I won't say well educated society) if one see's a car broken down on highway especially at this hour, one would see whether they need help or would offer a helping hand. In short what happened is the women was raped in-front of her children and the criminals are still on the loose.

NGO's protecting criminals from punishments

What should be done with these low life scumbag rapists? What has been done in the past years with such rapists?! I remember in 2018, the case of a little innocent girl Zainab in Kasur, although the scumbag criminal rapist was hanged but due to pressure of several NGO's and foreign pressure that punishment was not carried out in public although the public insisted to punish the criminal publicly but due to the pressure it wasn't. After that case several more cases took place in Kasur. Why should the rapist or any other criminal be punished in public? It is common psychology if one criminal is punished publicly ten to twenty criminals who were thinking of doing the same crime gets scared that's why Islam tells us to carry out punishment of such criminals in public. Whenever there is such a case human rights organisation comes to the rescue of these criminals and start pressurising the government from taking bold steps. These so called human rights organisation they don't see the blood of Palestinians, Syrians, Libyans and many more Muslim victims being shed, they are silent for those people. I don't get it these so called NGO's trying to protect this abhorrent crime by saying that they are mentally ill people and they should not be punished so violently and on the other hand our Political parties playing politics with the families of the victim.


Punishment of Rapist decreed by Allah





The punishment for the rapists according to shariah is same as that of Zina, which is stoned to death. In this case many scholars added one more thing to it.

Imam Maalik (may Allaah have mercy on him) said: 

In our view the man who rapes a woman, whether she is a virgin or not, if she is a free woman he must pay a “dowry” like that of her peers, and if she is a slave he must pay whatever has been detracted from her value. The punishment is to be carried out on the rapist and there is no punishment for the woman who has been raped, whatever the case. End quote. 

Al-Muwatta’, 2/734 


Imam Shafi is also of the same view but Imam Abu Haneefa and Al Tawri said that the rapists is not obliged to give the dowry although the punishment should be given.

If the rapist used a weapon to threaten then there is an addition in the punishment as said by Allah Subhanu Tallah in 

Surah Maida 5:33

“The recompense of those who wage war against Allaah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter”

same is the punishment for robber who uses weapon to threaten people and then steals property of someone.


The first religion to give respect and status to women 


West says that we have given rights to women. I say that Islam has given honour and respect to women. Women in Islam as a mother has great status who must be obeyed, respected and treated with kindness . When one pleases her mother it is same as pleasing Allah. Women in the role of sister and wife is given great deal of respect. Women in Islam are not given difficult duties like that of given to Men. Women won't be asked about whether she earned halal money or not, She won't be asked whether she worked to create an Islamic state or not etc. Allah revealed a whole Surah in their name An Nissa.

Now let's talk about one thing whenever these type of incidents occurs actresses are called on talk shows to talk about these issues. Let me make one thing clear here, the world is rapidly progressing every person no matter where he is has access to internet these days and with internet, means every type of content is in his pockets. If a person is watching glamorous content 24/7 he will definitely need to release his frustration. Which doesn't mean that these rapists are justified they are not! these inhumane people are not, I condemn this act but if you have a little bit of common sense one would know that these two things are co-related. These things should stop these glamorous Ads and glamour on TV 24/7 should stop. 


Allah's verdict

As positive and negative attract each other, so does men and women that's a universal fact. Allah has given clear guidelines regarding it. People say that whenever these type of incidents occur everything is blamed on women, she is asked to do this this and this. In Quran Allah first addresses men


"Tell the believing men to lower their vision and guard their private parts. That is purer for them. Indeed, Allah is Acquainted with what they do". (Surah Nur 24:30)

and then Allah addresses women

"And tell the believing women to lower their vision and guard their private parts and not expose their adornment except that which [necessarily] appears thereof and to wrap [a portion of] their headcovers over their chests...."(Surah Nur 24:31)

and the Prophet SAW said to men

Narrated Abu Sa`id Al-Khudri:

The Prophet SAW said, 'Beware! Avoid sitting on the roads." They (the people) said, "O Allah s Apostle! We can't help sitting (on the roads) as these are (our places) here we have talks." The Prophet SAW said, ' l f you refuse but to sit, then pay the road its right ' They said, "What is the right of the road, O Allah's Apostle?" He said, 'Lowering your gaze, refraining from harming others, returning greeting, and enjoining what is good, and forbidding what is evil."

(Sahih Bukhari 6229)

and while talking to strangers Allah commanded the wives of Prophet SAW the purest of all and those who were most fearful of Allah among women. They are commanded that IF YOU FEAR ALLAH do this.

"O wives of the Prophet, you are not like anyone among women. If you fear Allah, then do not be soft in speech [to men], lest he in whose heart is disease should covet, but speak with appropriate speech."

(Surah Ahzab 33:32)

Well Coming back to the topic rapists should be punished severely and in public and no mercy should be shown to them and those who support or have mercy for rapists and speaks for them should be punished as well without any discreet even if they are Ministers of Parliament. 


O Allah! Enable us to see the Truth as Truth and give us the ability to follow it. And show us the falsehood as false and give us the ability to refrain from it. Ameen
